Please read these Terms and Conditions ("Terms", "T&C") carefully before using the Zilemu website, mobile application, and accessing our information, programs, and services (collectively, the "Service") operated by Zilemu ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Health and Medical Disclaimer (Critical)

The Service provides information and tools related to health, fitness, nutrition, and stress management. This information is designed for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

1.1. Not Medical Advice: The Service, including any customized programs, written materials, videos, or direct communications, is not medical or psychological advice and does not replace consultation with a qualified healthcare professional.

1.2. Consult Your Doctor: You are strongly encouraged to consult with your physician or other healthcare provider before starting any new fitness, nutrition, or stress-management program, especially if you have pre-existing health conditions, injuries, are pregnant, or believe to be .

1.3. Assumption of Risk: By using the Service, you acknowledge and agree that you are voluntarily participating in these programs and assume all risk of injury, illness, or death arising from or in connection with your use of the Service.

1.4. Accuracy: While we strive to provide accurate and up-to-date information, we make no guarantees regarding the accuracy, completeness, or suitability of the information provided for your specific needs.

2. User Accounts and Data

2.1. Account Creation: When the account functionality becomes available, you agree to provide accurate, complete, and current information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account.

2.2. Data Collection: We will collect personal data, health data (via optional surveys), and web/mobile app usage data. The collection and use of this data are governed by our separate Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the collection and use of your data as outlined in the Privacy Policy.

2.3. Age Restriction: You must be at least 18 years old to create an account and use the paid features of the Service.

3. Subscriptions and Payments

3.1. Subscription Service: Certain parts of the Service are billed on a subscription basis (e.g., monthly, quaterly, or annual). You will be billed in advance on a recurring, periodic basis.

3.2. Billing and Auto-Renewal: By selecting a subscription, you authorize us to charge your designated payment method the applicable subscription fee at the beginning of each billing cycle. Your subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it.

3.3. Fee Changes: We reserve the right to change the subscription fees for the Service at any time. Any fee change will become effective at the end of the then-current billing cycle. We will provide you with reasonable prior notice of any change.

3.4. Cancellations and Refunds:

• Cancellation: You may cancel your subscription renewal at any time through your Account Settings or by contacting us at info@zilemu.com. Cancellation will take effect the day after the last day of the current subscription period, and you will be able to access the Service until then.

• Refunds: Except when required by law, paid subscription fees are non-refundable. One-time purchases of digital goods or services are also generally non-refundable unless otherwise stated at the point of purchase.

4. Intellectual Property Rights

4.1. Ownership: The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Zilemu and its licensors. This includes —but is not limited to, all written guides, PDFs, videos, podcasts, program designs, and the underlying software code.

4.2. Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use only.

4.3. Prohibitions: You may not copy, reproduce, modify, distribute, display, or sell any part of the Service content without our express prior written permission.

5. Limitation of Liability

In no event shall Zilemu, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

6. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of the United States of America.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
